Topic description
La mutualisation du DPO, autorisée par le RGPD, offre la possibilité de désigner un seul DPO pour plusieurs entités, ce qui pourrait réduire les coûts et favoriser l'indépendance du DPO. Cependant, malgré son potentiel, la mise en place de la mutualisation reste limitée, notamment dans le secteur public, ce qui soulève des préoccupations quant à la conformité de ce dernier ainsi que quant à l'effectivité du cadre légal. Une enquête européenne récente a mis en évidence les défis rencontrés par les DPOs laissant supposer que la mutualisation pourrait mettre en question l'effectivité de la protection des données personnelles. Le projet vise ainsi de déterminer les conditions légales et les critères d'évaluation pour garantir le succès de la mutualisation du DPO et éviter une non-conformité potentielle des organismes optant pour la mutualisation. La recherche juridique en France n'a pas pleinement exploré ce sujet. Ce projet de recherche doctoral vise à combler cette lacune en examinant le potentiel et les limites de la mutualisation du DPO, ainsi que les cadres légaux nécessaires pour son efficacité, en utilisant des méthodes telles que le droit comparé et les enquêtes sur le terrain.

The mutualisation of Data Protection Officers (DPOs), as authorized by the GDPR, presents the opportunity to appoint a single DPO for multiple entities, potentially reducing costs and bolstering the independence of the DPO. Despite its promise, the adoption of pooled DPOs remains limited, especially within the public sector, raising concerns about compliance and the efficacy of the legal framework. Recent European surveys have underscored the challenges faced by DPOs, suggesting that mutualisation could compromise the effectiveness of personal data protection.
This project seeks to identify the legal prerequisites and assessment criteria necessary to ensure the success of DPO pooling and mitigate potential compliance risks for organizations adopting this approach. While legal research in France has yet to thoroughly explore this topic, this doctoral project aims to address this gap by investigating the potential and constraints of DPO mutualisation, alongside the requisite legal framework for its efficacy. This will be accomplished through methodologies such as comparative law analysis and empirical field surveys.

Candidate's profile
Sur fond de maîtrise du droit privé et du droit public dans son ensemble, une solide connaissance du cadre européen et national de la protection des données personnelles, est requis ainsi que du droit de l'Union européenne.
La candidate devra justifier une première expérience dans le domaine de la recherche juridique, à ce titre avoir rédigé un mémoire de niveau Master 2 ayant obtenu une moyenne supérieur' à 12/20.
Au-delà de ces prérequis d'ordre académique, la candidate doit avoir une fine connaissance de la mise en conformité du RGPD dans le secteur public ou le secteur privé.
The ideal candidate for this position should possess a robust academic background, in private and public law, with a strong emphasis on understanding both the European and national frameworks governing the protection of personal data, along with a comprehensive grasp of European Union law. Additionally, prior experience in legal research is a prerequisite, as evidenced by the completion of a Master 2 dissertation with an average grade exceeding 12/20.
